Terms of service

Terms of Service

These terms govern your use of this website and your purchase of products from The Funk Firm. By placing an order, you agree to them.

Who we are

The Funk Firm [ARTHUR-FACT: full registered legal entity, e.g. "The Funk Firm Ltd, a company registered in England and Wales, company number 12345678"] Registered address: Newhaven Business Centre, Denton Island, BN9 9BA, United Kingdom VAT number: [ARTHUR-FACT: VAT registration number, if VAT-registered] Email: info@funkfirm.co.uk

How a contract is formed

When you place an order through our website, you are making an offer to buy the products at the prices and on the terms shown. A contract is formed — and your order is accepted — when we send you an email confirming the items have been dispatched, not at the moment of payment. We reserve the right to refuse any order before that point, including for reasons of stock, suspected fraud, or pricing error.

Prices and payment

All prices are in pounds sterling (GBP) and include UK VAT where applicable. Prices for international markets are converted at the current exchange rate and rounded to the nearest 95 pence.

International orders may be subject to import duties and taxes charged on delivery. Unless we explicitly state otherwise (for example for IOSS-included EU pricing), these are your responsibility.

We accept payment by credit or debit card (via Shopify Payments) and by PayPal. Payment is taken at the point of order.

Pricing errors. Despite our best efforts, prices on the website may occasionally be wrong. If we discover an error in the price of a product before we dispatch it, we will contact you for instructions; you are under no obligation to proceed at the corrected price, and we will refund you in full if you choose not to.

Delivery

Delivery terms, carriers, and timescales are set out in our Shipping Policy.

Right to cancel and returns

Your right to cancel a non-faulty order, and the conditions for returns and refunds, are set out in our Refund Policy. Nothing in these terms affects your statutory rights as a consumer.

Warranty

Vector SE, Saffire, and the Akutrak phono stage are covered by a 7-year manufacturer's warranty. Other Funk Firm products are covered by the standard manufacturer warranty applicable to their type. Audio Technica cartridges sold by us are covered by Audio Technica's own warranty terms.

The warranty covers defects in materials and workmanship in normal domestic use. It does not cover damage caused by accident, misuse, unauthorised modification, or normal wear.

Intellectual property

The Funk Firm name, our logo, and all product designs, technical innovations, and patents — including but not limited to Achromat, F·X Cross Beam tonearm technology, Vector Drive, REER (Rear End Energy Rejection), and the Isolation Bubble concept — are the property of The Funk Firm. Nothing on this site grants you any licence to use them.

Liability

To the fullest extent permitted by law, our liability for any claim arising from the purchase or use of our products is limited to the price you paid for the product. We are not liable for indirect or consequential loss.

Nothing in these terms excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law — including your statutory rights as a consumer.

Governing law

These terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We may update these terms from time to time. The version in force at the time of your order is the version that applies to that order.
